Waste management in urban management processes

The purpose of urban management is to transform the land in accordance
with the Planning model, generating a city and guaranteeing the satisfaction
of the citizens’ needs. The decontamination and management of waste constitutes
an essential function of the promoter process, especially when it falls on
degraded spaces or with a history of industrial activities. Legislation on waste
is based on the principle «whoever pollutes pays», but, on occasions, jurisprudence
has rejected this criterion, charging developers with the costs of decontaminating
and removing waste, understanding that they are included in the
concept of urbanization costs. The statement on potentially polluting activities
in transmissions has been generalized by the recent reform of Law 7/2022, of
April 8, on Waste and Contaminated Soils for a Circular Economy, favoring
transparency in this matter.
