Valuation of the monetization of public networks and facilities in integrated actions

Abstract

The impossibility of transferring public land in kind in integrated development projects leads to payment of the equivalent in cash. This monetization process does not coincide with that which occurs when the land reserved for development rights, usually called "ten percent," is not transferred, because the land designated for green areas or public facilities is not for profit. A sector of legal scholars and case law advocates equating the valuation in these cases to that of expropriated property whose potential economic benefit cannot be realized, applying Article 37 of the Consolidated Text of the Land and Urban Rehabilitation Law (TRLSRU 2015). This article sets out the reasons why this doctrine should not be consolidated, lest it undermine the essential principles of equitable distribution within development units and the substitution of unceded property with monetary equivalent.
