Abstract

The Law 12/2023 for the right to housing (LVIV) has modified the protected housing standards of the basic criteria for land use (art. 20) of Royal Legislative Decree 7/2015 which approves the consolidated text of the Land and Urban Rehabilitation Law (TRLSRU), and its tenure regime. These new determinations, in accordance with the jurisprudence of the Supreme Court on the direct application of them in the urban plans and execution instruments, may have important consequences on the economic viability of urbanization
actions and on the economic sustainability of the public treasuries affected by them.

Consequently, a comparative analysis of the national and regional regulations is carried out, regarding the different standards of subsidized housing and their tenure regime, to analyse its incidence on the urbanization actions of the basic regulation that must define them, both from the perspective of the right to Sustainable and Integrated Urban Development of the TRLSRU
and the right of access to housing of the LVIV
