A Comparative Study of Regulatory Models in Digital Environments

This study analyses the tension between privacy protection and the promotion of innovation in digital markets through comparisons of regulatory frameworks in the European Union and highlights, in particular, the situations in Spain and Brazil. The research points out the main discord between both fundamental values and examines how different regulatory approaches try to harmonize these simultaneous requirements. Through an exhaustive literature review and a thorough documentary analysis, the study demonstrates that data protection is crucial to guarantee the fundamental rights of individuals; however, it highlights that a regulatory framework that emphasizes flexibility and proportionality, while maintaining technological neutrality, can promote innovation without unduly infringing on individual privacy. This paper contributes to the academic dialogue by presenting a balanced regulatory model that recognizes privacy's contextual nature and highlights data's relevance as a driver of today's digital economy.
