ANÁLISIS DE LA PROPUESTA DE REGLAMENTO EUROPEO DE INTELIGENCIA ARTIFICIAL

Asistimos actualmente a una carrera por la regulación en
materia de inteligencia artificial que Europa está firmemente
decidida a liderar, consciente de sus limitaciones en materia
de soberanía tecnológica. Europa ha tenido claro desde un
inicio que debían marcarse unos límites para preservar la
salud, seguridad y los derechos fundamentales de las personas
frente al desarrollo de los sistemas de IA y ha elaborado una
propuesta normativa horizontal para garantizar su protección.
La propuesta de reglamento europeo de inteligencia artificial
se articula sobre un enfoque basado en el riesgo y el sistema
de evaluación de la conformidad proveniente de la normativa
europea sobre seguridad de los productos, para establecer
normas armonizadas que garanticen el marco jurídico único
necesario para el funcionamiento del mercado interior. A
pesar de que solo el tiempo dirá si el enfoque europeo es lo
suficientemente flexible para permitir la innovación a la par que
conseguir dichos objetivos y de que el texto es mejorable en
determinados aspectos, se trata de un buen punto de partida
que previsiblemente tendrá un importante impacto a nivel
mundial.
