Abstract

The Supreme Court judgment of October 30, 2018 modifies the last case law doctrine, maintained since 2008, in accordance with that, it was not possible to deconsolidate or degrade an consolidate urban land.

The new doctrine admits actions to renovate, rehabilitate or regenerate urban land when the administrative decision is sufficiently motivated and does not involve an infringement of the principle of equal distribution of benefits and burdens.
