Abstract

Generative artificial intelligence models have the capacity to produ- ce, with greater or lesser autonomy and independence from human intervention, results or contents that formally fit into the concept of a «work». The technological advance driven by artificial intelligence is profound and structural, and its impact on the artistic sector cons- titues a challenge in order to determine how to reconcile the integration of these intelligent models in the creative process with the current normative pillars that support copyright.
This paper sets out to analyse the response given, mainly, from the perspective of common law legal systems to requests for recognition and protection through copyright of the results generated (outputs) by artificial intelligence models. The choice to navigate the complexities of the regulatory frameworks of copyright systems is since, in these jurisdictions, the copyright dispute has become institutionalized and judicialized, with greater intensity than in «droit d’auteur» systems, with a more pronounced personalist approach. The study of the cases and lawsuits currently in progress will undoubtedly help to clear up uncertainties and advance in the search for solutions that respect the balance of the various conflicting interests
