Legal nature and ownership of rural paths

This paper carries out a legal characterization of local public paths. The study aims to contribute to their clear identification, preventing ignorance from being used as an excuse for failing to protect them from encroachment. The study is divided into four parts. The first part defines what is not considered a local public path, as distinct from private paths. The second part analyzes the characteristics that historical legislation has attributed to paths for public use. The third one performs the same analysis, but with respect to current legislation and case-law. Finally, the study concludes with a systematization of the defining elements of all local public paths, which are legally confirmed by their inclusion in the local public domain.
