The nature and validity regime of urban plans, issues that still demand an adequate solution

This paper addresses the historical process of the refinement of the urban development plan (using the general municipal plan as a reference) to understand how its current configuration has led to its classification as an administrative provision and, consequently, to the invalidity of its provisions. Based on this, and after referring to the current doctrinal and jurisprudential state of the issue, as well as a brief overview of the most relevant comparative solutions for our purposes, it analyzes initiatives aimed at overcoming this unsatisfactory situation and, in light of this analysis, suggests some areas for improvement in the solutions offered by these initiatives.
