Private Use of Public (Groundwater) Water: Forty Years of the 1985 Water Law

In the year 2025, twenty-five years Will have passed since the approval of the Water Law of 1985. This law marked a significant change in the legal regime of inland waters, as it established that all types of water, particularly underground waters, would fall under public hydraulic domain. However, with regard to these underground waters, the 1985 law did not represent a complete break from previous regulations, as the same law created mechanisms to transition from the old system to the new one that would be implemented from then on. These mechanisms, it must be said, have not achieved the results the legislator likely expected. Moreover, the design of these mechanisms, which has been revised several times, has not been without criticism concerning their accuracy and functionality.
