Abstract

The battered article 47 of the Spanish Constitution, continues to affirm with laconic expression that «everyone has the right to decent and adequate housing», a phrase that ages at the same time as a neat Spanish regulation on aspects related to building, housing planning - state or regional - and the longawaited remedies first against speculation. and then to alleviate the vulnerability,
residential exclusion, and social fragmentation that such a precious good produces in society. We are still unable to extract specific competence titles from its wording, (although the Constitutional Court has been in charge of pronouncing on multiple occasions), although we can find for the first time in democracy a state law that aspires to fill the regulatory space in the matter by the AGE. Norma, relevant of the first order, whose analysis these lines do not intend to escape, focused more on the relevant issues that ask us to pay attention to the vulnerability that they integrate and their social projection and that denote lights and shadows, as well as lost and dreamed opportunities to regulate something important that has taken more than 40 years to materialize, and the result of which presents many indubitable reflections of which this work intends to be one more note of lege ferenda.
