Abstract

The Spanish Act 12/2023, of May 24, 2023, is a groundbreaking new European regulation in the field of housing, an area where European citizens are facing increasing problems. It is the first law on housing passed by the Spanish Parliament in democracy and affecting the whole country since the enactment of the Constitution in 1978.
From a legal point of view, the Act declares affordable housing as a Service of General Interest, which shows the increasing influence of EU law and categories in the field of housing; regulates some techniques (e.g., rentcontrols) which are already included in other European regulations; and tries to link housing and land use regulations. The integrated perspective of affordable housing and zoning is a relevant connection, which in the Spanish legal system, like in other countries, has been partially forgotten historically.
