The necessary complete internal regulation of energy communities in Spain

At the end of 2016, the European Commission, within the framework of
the «Winter Package», proposed placing citizens at the center of the energy
transition.
And aware that the administrations closest to the citizenry are the local
ones, he proposed, based on the Renewable Energy Directive and the Internal
Electricity Market, the creation of two figures included in the broad concept
of «Local Energy Communities»: the Renewable Energy Communities and the
Citizen Energy Communities, where citizens, local companies and local
authorities take center stage.
The main purpose of this doctrinal article is to be able to contribute to
the necessary complete transposition that in this matter must take place in our
internal legal system, given that despite the fact that these figures have been
partially collected in 3 Decree-Laws, we still do not have a legal norm that
regulates completely and in its maximum expression the figure of the EC in
our country, for which the present doctrinal article intends to make a series
of doctrinal and de lege ferenda contributions in order to comply with said
mandate , creating the appropriate legal framework to meet the objectives set
out in the aforementioned Directives, building the favorable environment that
allows their development, and thereby contributing to the decarbonization of
the energy system of our country.
