The municipal competency for the tourist housing urban planning

In the article the scope of the municipal powers for the organization of the houses of tourist use is raised. For this, in the first place, the activity as a tourist service is legally conceptualized and the critical position of the CNMC before its regulation is exposed. Secondly, municipal jurisdiction over urban planning is valued as an enabling title for the eventual adoption of management
measures. Thirdly, the main specific urban planning instruments approved are described, and the case law related to them is examined. Based on the aforementioned, finally, it is a question of delimiting the competence of municipal urban planning on tourist use housing and the compelling reasons of general interest that may justify it.
