Abstract

In order to allow the development of quality urbanizations, mainly for second homes and tourism whose maintenance is too hard for municipality, the owners can assume the duty of conservation of the urbanization and the maintenance of the services, being obliged to become an urban conservation body. The nature of these entities has been much discussed, but certanly they
participate in the satisfaction of certain public functions. In these cases their actions must be considered administrative in nature and controlled by the Administration, satisfying owners private interests grouped in the entity meanwhile.
The primary purpose that they fulfill, assuming the duty of conservation of the urbanization, must be openly understood, looking for optimizing this instrument of public-private collaboration. This function, which also prosecutes private interests, must be strengthened. Affirmating the necessary link of their aims with urban development, and trying to avoid anyelse collision with the
negative aspect of the right of association, these entities must be allowed to become an instrument of co-governance of public space, of social dynamization of common areas such as essential element for its proper use and conservation
