Abstract

This article reviews the current legal framework for the protection of the historical-artistic real estate heritage, the most significant legal questions raised through the courts, as well as the particular regulation around the urban intervention in the municipality of Madrid. The analysis argues that the procedure for intervention on protected heritage, through license and responsible statement, strikes the right balance between the urban planning and the protection of the historical heritage at risk.
